Terms of Service
1. Service Description
Nanorix Inc. ("Nanorix," "we") provides an API for ephemeral computation with cryptographic destruction proofs ("CDPs"). The service creates isolated computing environments, processes data in volatile memory, destroys data through a verified multi-step cryptographic sequence, and generates signed proofs of destruction.
2. Account Registration
One account per email address. You are responsible for maintaining the security of your API key. API keys are shown once at creation and cannot be retrieved afterward. If your key is compromised, contact hello@nanorix.io immediately for revocation and reissue.
3. Acceptable Use
You agree not to: use the service for any illegal activity, attempt to circumvent security controls or isolation boundaries, create automated or bulk accounts, use the service to process data that violates applicable law, or attempt to extract data from other customers' capsules.
4. Service Tiers and Billing
Free Tier: 100 CDPs per month, 5-minute maximum TTL, 3 concurrent capsules. Nanorix may modify free tier limits with 30 days' notice.
Paid Tiers: Platform fees are billed monthly via Stripe. Per-proof charges ($0.04 per CDP) are billed at the end of each billing cycle based on usage. All prices are in USD.
Refund Policy: Platform fees are non-refundable for partial months. Per-proof charges are non-refundable for proofs already generated. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
5. Service Level
Free, Starter, and Business tiers: Nanorix provides the service on a commercially reasonable efforts basis. No uptime guarantee is provided.
Enterprise tier only: 99.9% SLA, contractual. SLA terms are defined in the Enterprise agreement.
6. Your Data
You retain all rights to data you send into capsules. Nanorix processes data solely for service delivery. Nanorix does not retain capsule content. Data exists only in volatile memory during capsule execution and is destroyed through the multi-step cryptographic destruction sequence upon capsule termination.
7. Cryptographic Destruction Proofs
CDPs are generated by Nanorix and provided to you. You may share, store, present, and distribute CDPs freely. CDPs contain cryptographic hashes, signatures, and metadata — they do not contain customer data.
8. Regulatory Context
The regulatory_context included in CDPs is a factual reference mapping to regulatory provisions. It is not a compliance certification. Nanorix makes no warranty regarding regulatory compliance. Compliance determinations are your responsibility, in consultation with qualified legal and compliance professionals.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Nanorix's total liability for any claims arising from or related to the service shall not exceed the fees paid by you in the twelve (12) months preceding the claim. Nanorix shall not be liable for indirect, incidental, special, consequential, or punitive damages.
10. Intellectual Property
Nanorix retains all intellectual property rights in the service, including the destruction chain architecture, CDP format, and verification algorithms. The Nanorix system is patent pending.
11. Termination
Either party may terminate the agreement at any time. Upon termination: your account is deactivated, existing CDPs remain available for retrieval for 90 days, and after 90 days, account data is permanently deleted. You may request immediate deletion of account data at any time.
12. Governing Law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
13. Changes to Terms
Nanorix may update these terms with 30 days' notice via email to registered accounts. Continued use of the service after the effective date of changes constitutes acceptance. If you disagree with changes, you may terminate your account before the effective date.
